Privacy Policy

Plain English: We collect minimal data. We never sell your data. We don't show ads today — and if we ever introduce personalized recommendations or marketing based on your favorites, we'll tell you clearly first and, where the law requires it, ask for your consent. If you don't sign in, your preferences and favorites stay only on your device. If you sign in with Google, we save your favorites on our server so they sync across your devices.

1. Who We Are

2. What We Collect

Without sign-in (anonymous use):

Slider preferences, region/gender filters, and favorites — stored only on your device (browser localStorage). Never sent to our servers. If you clear your browser data, this information is lost.

When you sign in with Google, we store on our servers:

Account profile — email address, display name, profile picture URL, and a Google user identifier received from Google when you sign in.
Sign-in activity — the timestamp of your account creation and your most recent sign-in.
Favorites — the brand names you mark as favorites, linked to your email, so they sync across your devices.
Monthly usage counter — the number of analyses you have run in the current calendar month, used to enforce the free-tier limit. No analysis content is stored.
Subscription status — a flag indicating whether you have Premium access, when it expires, whether you have started your free trial, and a non-identifying Google Play purchase token used solely to verify your subscription.

3. What We Do NOT Collect

We do not access your camera, microphone, contacts, or location.
We do not place tracking cookies or use third-party advertising trackers.
We do not track you across other websites.
We do not collect payment card details (subscriptions handled by Google Play).
We do not collect data from children under 13.
We do not send your slider values, match results, or analysis history to our servers. All matching is computed locally on your device.
We do not currently use third-party behavioural analytics products such as Google Analytics, Mixpanel, or similar tools.

4. How We Use Your Data

To calculate brand match scores based on your slider settings (runs entirely on your device).
To sync your favorites between your phone, tablet, and computer when you sign in.
To verify your Premium subscription status and track your monthly free-tier analysis count.
To keep your sign-in session valid and detect inactive accounts.

Legal Basis for Processing (GDPR Article 6): Performance of a contract (Art. 6(1)(b)) for account profile, favorites sync, and subscription status. Consent (Art. 6(1)(a)) for signing in with Google. Legitimate interest (Art. 6(1)(f)) for infrastructure logs.

5. We Never Sell Your Data

We do not sell, rent, or trade your personal data to any third party. BrandNiche is funded primarily by subscriptions, not by advertising. We do not display ads and we do not sell your data.

6. Third-Party Services

Supabase — hosts our database. EU (Frankfurt). See supabase.com/privacy.
Google Sign-In — authentication only. See policies.google.com/privacy.
Google Play Store — payment processing for subscriptions. We do not receive your payment card details.
Netlify — static hosting. See netlify.com/privacy.

7. Your Rights (GDPR / CCPA)

Right to access — request a copy of all data. Available in-app: Settings → Export My Data.
Right to correct — email us with corrections.
Right to delete — Available in-app: Settings → Delete My Data. See also our Account Deletion page.
Right to data portability — the in-app Export returns your data as a machine-readable JSON file.
California users: we do not sell personal information.

To exercise rights that cannot be completed in-app, email support@acy-studio.com. We respond within 30 days.

8. Data Retention

On-device data — stored until you clear your browser data.
Account profile & favorites — retained until you request deletion or until your account is inactive for 24 months.
Monthly usage counter — retained for 13 months, then automatically deleted.
Subscription records — retained 7 years per tax regulations (non-identifying tokens only).

9. Children's Privacy

BrandNiche is not directed at children under 13. We do not knowingly collect data from children under that age. If you believe a child has provided us with personal data, email us and we will delete the data promptly.

10. Security

All data in transit is encrypted via HTTPS/TLS. Database access is restricted via Row-Level Security and service-role keys are never exposed to the client.

11. Data Breach Notification

In the unlikely event of a data breach, we will notify you by email within 72 hours in accordance with GDPR Article 33.

12. Changes

Material changes will be notified via in-app message. Continued use constitutes acceptance.
